Litigation

The process of resolving a dispute through the court system. Insurance claims that end up in litigation usually involve coverage questions, bad faith claims, or disagreements about the extent of damage. Litigation is costly and long, which is why contractors and carriers prefer to resolve disputes through supplements, appraisals, or negotiated settlements. Accurate documentation and a defensible estimate are the strongest tools for staying out of court.
